Umno Youth, Wanita Umno lodge police report against JAG

JOHOR BARU, 6 Oct 2009: Johor Baru Umno Youth and Wanita Umno today lodged a report against the Joint Action Group for Gender Equality (JAG) to have the organisation investigated under the Sedition Act for interfering in the caning sentence on part-time model Kartika Sari Dewi Sukarno.

Johor Baru Umno Youth chief Khalid Mohamed and Wanita Umno chief Salmah Saffar made the report at the central police station here at 1:40pm.

Salmah said the police report was made because JAG’s intention to get an order for suspension, amendment or revocation of the caning sentence imposed on Kartika by the Syariah Court was dangerous, and challenged the position of Islam as the official religion of the country.

“JAG’s demand also does not respect the position of the Yang di-Pertuan Agong and the Malay rulers as the heads of Islam in the country, besides provoking the emotions of Muslims and therefore leading to religious conflict that may rock the communal harmony in this country,” she said after making the report.

Salmah said JAG had no right to question the decision of Kartika and her family to accept the sentence.

Khalid said his movement viewed JAG’s action seriously and hoped the investigation could be done swiftly.

Kartika Sari Dewi, 32, was fined RM5,000 and sentenced to be caned six times by the Syariah High Court in Kuantan on 20 July after admitting to drinking alcohol in Cherating, Pahang on 11 July 2008.

The caning was recently postponed to respect the month of Ramadan. 

JAG recently characterised the caning sentence as cruel, saying it violated international human rights and humiliated a person. It called on the government to abolish the Syariah criminal laws enforced in the states.

In ALOR STAR, Kedah Menteri Besar Datuk Seri Azizan Abdul Razak said there was no reason for any quarter to question the implementation of syariah laws in the country, given that Islam was the official religion and that those laws had long been used.   

“Why question existing laws? [JAG] just [wants] to get publicity; [they are] wasting time, causing heartache and creating an unstable situation,” he said. — Bernama

    Go on [and] cane. As if anybody cares. It only proves Islam is a religion of don’ts. I feel sorry for the followers.

    Terlebih dahulu saya ingin meminta maaf kepada pengarang dan para pembaca jika komen saya menyinggung perasaan sahabat-sahabat sekelian.

    Merujuk kepada kenyataan Pemuda dan Wanita Umno Johor di atas, dan pihak-pihak lain yang memegang pendirian yang sama berkenaan kes Kartika, saya tertanya apa sebenarnya yang dilakukan JAG sehingga boleh dikelasifikasikan sebagai “menghasut”.

    Benar, mereka tidak setuju dengan hukuman maksima yang diputuskan oleh Mahkamah Syari’a Pahang terhadap Kartika yang baru pertama kali disabit dengan kesalahan ini. Mereka juga menyoal mahkamah tersebut apabila rujukan dalam kes Kartika baru-baru ini tidak mengambil kira rayuan yang difailkan oleh SIS sebagai pihak ke-tiga yang berkepentingan.

    Dan ya, mereka mengambil pendirian ini walaupun saudari Kartika sendiri nampaknya menerima hukuman maksima yang dikenakan terhadap beliau.

    Setuju atau tidak dengan pendirian mereka, langkah-langkah yang diambil oleh JAG atau SIS setakat ini tidak luar biasa dalam amalan masyarakat yang bertamadun. Ia juga tidak luar biasa dalam proses perundangan, melainkanlah jika sistem perundangan Shari’a kita dianggap sebagai satu sistem yang luar biasa.

    Di sini pula timbul persoalan, jika luar biasa dalam ertikata apa? “Special” atau “strange”?

    Kenyataan Pemuda dan Wanita Umno Johor di atas, dan pihak-pihak lain yang memegang pendirian yang sama, seolah-olah mempertahankan satu sistem perundangan Shari’a yang “strange”, dan bukan “special”. Jika “special”, ertinya sistem itu tentulah yang paling rasional, adil dan telus prosesnya, serasi dengan shari’a Islam.

    Merujuk kembali kepada kenyataan JAG baru-baru ini, saya sendiri tidak terjumpa apa jua usul yang menghasut umat Islam di Malaysia untuk bertelagah antara satu sama lain. Malah, tiada pun unsur pengkhianatan terhadap DYMM Tuanku.

    Jika tindakan memfail rayuan dalam kes Kartika dianggap mencabar kedudukan DYMM Tuanku sebagai ketua Agama Islam dan Negara, maka setiap rayuan kes dalam kedua-dua sistem perundangan Shari’a dan sivil juga boleh dikatakan sebagai tindakan mengkhianati DYMM Tuanku! Masha’Allah…

    Hakikatnya ialah sebagai negara yang merdeka, kedua-dua pihak, JAG atau SIS dan para pembangkangnya, sama-sama berhak untuk bersuara secara sivil dan sama-sama berhak menggunakan sistem perundangan yang sedia ada.

    Rakyat Malaysia sepatutnya sudah matang dan tidak perlu mengancam satu sama lain dengan membangkitkan Akta Hasutan setiap kali timbul perbezaan pendapat.

    If it is sinful to drink beer, then investing in a company that brews beer must also be sinful. Caning is meted out for drinking. What is the punishment for investing in brewing of beer? Any judgment by any court presided by a human being is open to question.
