Nizar wants five appeal court judges

PUTRAJAYA, 18 May 2009: Datuk Seri Mohammad Nizar Jamaluddin today filed an application for a panel of five Court of Appeal judges to hear his application to set aside the court’s decision last week to stay a High Court declaration that he was the rightful menteri besar of Perak.

Lawyer Leong Cheok Keng, representing Mohammad Nizar, when contacted  said the application letter was sent by fax to the office of the Deputy Registrar of the Court of Appeal here at 4pm.

The basis for the application was that the case, that is set for hearing on 21 May, involved public interest, besides involving constitutional issues and questions, he said.       

On 11 May, High Court Judge Datuk Abdul Aziz Abdul Rahim declared Mohammad Nizar as the rightful Perak Menteri Besar finding that Mohammad Nizar did not vacate his position as menteri besar as he had not lost the confidence of the majority of the state assembly.

Following the decision, Datuk Seri Dr Zambry Abdul Kadir filed an application for a stay of the declaration that was heard and allowed by Court of Appeal judge Datuk Ramly Ali.

Mohammad Nizar then filed an application on 13 May to set aside the decision of the Court of Appeal. — Bernama
